MuslyWave, last updated 24 September 2026
These terms are the agreement between you and MuslyWave about your use of the MuslyWave app and everything in it. By using MuslyWave you accept them. If you do not, do not use the app.
MuslyWave is made and run by an independent developer based in Italy, working alone, not by a company with a support department. That is worth knowing before you read the rest: an answer to an email may take a few days, and the person answering is the person who wrote the app.
They were last updated on 24 September 2026, and they replace any earlier version you may have accepted.
You must be at least 13 years old, and old enough in your own country to agree to a contract. If you are under the age of majority where you live, your parent or guardian must agree to these terms on your behalf.
You sign in with Google or with Apple. You are responsible for what happens under your account and for keeping access to the provider account you signed in with.
MuslyWave organises and plays audio and video hosted on YouTube. We do not host that content, we do not own it, and we cannot guarantee that any particular track stays available, the rights holder or YouTube can remove it at any moment, and when that happens it disappears from MuslyWave too.
Because playback goes through YouTube, your use of MuslyWave is also subject to the YouTube Terms of Service at https://www.youtube.com/t, and to Google's Privacy Policy at https://policies.google.com/privacy.
MuslyWave Pro is a paid subscription. It removes advertising and unlocks profile customisation, a custom banner, including an animated one, a font and a colour for your name, and whatever else is described on the subscription screen at the time you buy.
You cancel in Settings → your name → Subscriptions on your device, not inside MuslyWave, Apple does not let us do it for you. Cancelling stops the next renewal; the subscription stays active until the end of the period you have already paid for.
When a subscription lapses, the things it unlocked stop being shown: advertising returns, and a custom banner, name colour or uploaded font is hidden. Nothing is deleted, if you subscribe again it all comes back exactly as it was.
Refunds for purchases made through the App Store are handled by Apple under its own policy, at https://reportaproblem.apple.com. We cannot issue them ourselves. Nothing here removes a right to withdraw or to a refund that the law of your country gives you and that cannot be waived.
A free trial is for new subscribers only and can be used once per account and per store (Apple or Google). Its length and the price that follows are shown before you confirm. At the end of the trial the subscription renews automatically at that price, unless you cancel at least 24 hours before the trial ends; cancelling during the trial costs nothing. A gifted subscription lasts for the stated time and then ends. Unused time has no cash value and is not transferable.
We may change the price of a plan. A change never applies to a period you have already paid for, and Apple will ask you to confirm before charging a higher price.
Unless you subscribe, MuslyWave shows advertising, and it is what pays for the service and for the creators on it. You agree not to block, hide, automate, falsify or otherwise interfere with the display or counting of advertisements. Doing so is a breach of these terms and may end your account and any earnings attached to it.
The Creator Program lets people who upload their own music earn money from the plays their tracks receive on MuslyWave. Joining is optional and free, and the program is open only while we keep it open.
We may change the levels, the missions or the minimum withdrawal, or pause or close the Creator Program, by updating these terms and the app. A change never reduces earnings you had already validly reached before it. If the program is paused or closed, you can still withdraw the balance you had validly earned, under the rules above.
Some creators receive a discount code from us. People who use it pay less for MuslyWave Pro, and the creator earns the share shown on their code screen of what those people actually pay, minus refunds. It can be withdrawn from the minimum shown on that screen, under the same rules on payments, tax and fraud as above.
Playlists, comments, replies, names, notes, images and fonts you upload are yours. You keep every right you had in them.
By posting something publicly in MuslyWave you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it inside the app and in material promoting the app, for as long as you keep it posted. Delete it, and the licence ends, except for copies we are required to keep by law and for anything another person has already legitimately saved.
That licence covers what you post publicly and nothing else. A private message is not covered by it: we store it and deliver it because that is what you asked the app to do, and we do not display it anywhere, put it in anything promoting the app, or use it for any other purpose.
You promise that what you post is yours to post, and that it is not:
We may remove anything that breaks these rules, and may suspend or ban an account from the community, temporarily or permanently, without warning where the breach is serious. We are not obliged to monitor what is posted, and removing one thing does not mean we have reviewed everything else.
Every rule in this section applies to what you send in a message exactly as it applies to what you post in public. A message is more private, not more permitted.
There is no tolerance for abusive content or abusive behaviour here. Harassment, threats, hate, sexual content involving a minor, and content that exploits or endangers a child are grounds for removing the content and removing the account, with no warning and no appeal for the worst of them. We also reserve the right to report to the police anything the law requires us to report, or that we believe puts somebody in danger.
Every message has a Report option, held down on the message itself; every profile has Report and Block, from the menu at the top of a conversation or on the person's page. Blocking is immediate, it does not tell the other person, and it stops them writing to you at all.
A report reaches a person, not a machine. We aim to look at every report about a message or a profile within 24 hours, and to remove content and act on the account where it breaks these rules. If your content was removed and you think that was a mistake, write to [email protected] and say why; where the removal was of an image the app also shows you the appeal from inside it.
Anybody with an account can upload, free, with no limit on how much. There is no application and nothing to be approved for: you sign in, you pick a file, and it is up.
You do not have to be the performer. A label, a publisher, a manager, or anybody who holds or has been granted the rights can publish here — what matters is the rights, not who sang.
Nobody reads your upload before it goes online, and it is important that you know that rather than assume the opposite. There is no queue and no approval: a public track is live the moment it finishes uploading. What stands in the way instead is what happens afterwards — the claim process below, which is fast and which we take seriously.
Every upload is either public or private, and you choose which, at upload and at any time after. A public track can be found, played and shared by anyone. A private track is visible only to you: it is not in search, not on your profile, not in anybody else's library.
Private does not mean unseen by us. We still store the file, we still fingerprint it, and it is still covered by everything in this section — because a private track can be made public with one tap, and a rule that only applied to public tracks would be a rule anybody could step around by uploading privately first.
Every upload carries a declaration you tick, and we store that declaration word for word alongside the track. You are promising that you hold the rights to publish that recording, or that whoever holds them has given you permission. That is the one thing we cannot be flexible about: not "it was already on the internet", not "the channel is dead", not "nobody will notice".
The track goes offline the moment the claim arrives, before anybody reviews it. That is deliberate, and it is what the law requires of us. We then look at the claim: if it is upheld the track stays down for good, and if it is rejected the track comes back and nothing is held against you.
Two upheld claims pause your uploads. A third one closes your ability to publish permanently, and it cannot be applied for again. Re-uploading a recording that was already taken down closes it immediately — the file is fingerprinted, so the upload is refused before it starts.
That fingerprint outlives the track, the upload, and the account. Deleting your account does not clear it, and neither does deleting the track: a recording that was taken down after a claim cannot come back under a new name or a new account.
Beyond copyright claims we can remove, hide or edit anything uploaded here that breaks these terms, and we can do it without telling you first. We use that sparingly and we tell you afterwards, with the reason — but the notice comes after the removal, not before it, because content that has to come down has to come down now.
Your personal account is not affected by any of this. You keep listening, keep your playlists, keep your friends: what ends is publishing. Tracks of yours that nobody ever claimed stay online.
By uploading a track you give us a non-exclusive, worldwide, royalty-free licence to store it, stream it to listeners, and reproduce, distribute and display it together with its title, cover art and the details you typed in, inside the app and in material promoting the app, for as long as it is up here. Take it down and the licence ends. You keep the recording — it stays yours, you keep every other right in it, and you are free to publish it anywhere else at the same time.
Every published track has a Report button. Use it for a copyright claim, and also for anything that breaks the rules in "What you post" — the track goes offline straight away either way, and a person looks at it afterwards.
If you believe something in MuslyWave infringes your copyright, write to [email protected] with: what work you say is infringed, where in the app it is, your contact details, a statement that you believe in good faith that the use is not authorised, a statement that the information is accurate and that you are the rights holder or authorised to act for them, and your signature.
We will remove or disable access to material that is the subject of a valid notice, and we will terminate the accounts of repeat infringers. If your material was removed and you believe that was a mistake, write to the same address and say why.
Two different things sit behind that. Most of the music in MuslyWave plays from YouTube, and the audio and video themselves are hosted there, not by us: a complaint about one of those is best directed to YouTube, which can remove it at the source. Tracks uploaded by artists on MuslyWave are hosted by us, and a complaint about one of those goes to us — use the Report button on the track itself, which takes it offline immediately, or write to [email protected].
For notices under the United States Digital Millennium Copyright Act, the designated agent for MuslyWave is registered with the U.S. Copyright Office and is:
The service provider is Eraldo Shtylla, who also operates under the names MuslyWave, Musly Wave, muslywave.com and www.muslywave.com. The designation is on file with the U.S. Copyright Office under registration number DMCA-1079999 and can be looked up in the public directory at dmca.copyright.gov.
A notice sent to this agent is handled as described in "Copyright complaints" above, and must contain everything listed there. A notice that leaves out any of it is not a valid notice under section 512, and we may not be able to act on it.
We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use MuslyWave on a device you own or control, for your own non-commercial use, in accordance with the App Store Terms of Service. We keep every other right in the app, its name, its logo and its design.
You can stop using MuslyWave whenever you like, and delete your account from Settings → Delete Account. Deleting the account deletes your profile, your library, your listening, your comments and your uploads; an active subscription bought through the App Store must be cancelled separately with Apple, because we cannot cancel it for you.
We may suspend or end your access if you break these terms, if we are required to by law, or if we stop operating the service. If we end it for a reason that is not your breach, and you have paid for a period you cannot use, you may ask Apple for a refund of the unused part.
We work hard on MuslyWave, but we provide it "as is" and "as available". To the extent the law permits, we make no warranty that it will be uninterrupted, error-free, or that any particular track, playlist or feature will remain available. Where you deal with us as a consumer, this does not affect the rights your national law gives you and that cannot be excluded.
To the extent the law permits, we are not liable for indirect or consequential loss, lost profit, lost data, or loss caused by content posted by another user or by the unavailability of content hosted by YouTube. Our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or ten euro.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Where you obtained MuslyWave from the App Store, the following applies and takes precedence over anything inconsistent above:
We may change these terms. For a change that materially affects you we will tell you inside the app before it takes effect, and continuing to use MuslyWave afterwards means you accept it. If you do not, stop using the app and delete your account.
These terms, together with the Privacy Policy, are the whole agreement between us. If a court finds one part unenforceable, the rest still stands. Our not enforcing something once does not mean we have given it up.
These terms are governed by the law of Italy. If you are a consumer, you keep every protection the mandatory law of the country you live in gives you, and you may bring a claim in the courts of that country; nothing in these terms takes that away. For everyone else, the courts of Italy have jurisdiction.
